Liu Huan first introduced the global anti-dumping situation. In 2004, among the 209 global anti-dumping investigations initiated by WTO members, the number of cases involving petrochemical products topped 82, of which 46 were chemical products and 36 were plastic and rubber products. Among the 148 cases that adopted the final anti-dumping measures, the cases involving petrochemical products also ranked first, with 63 cases, of which 42 were chemical products and 21 were plastic and rubber products.
Liu Huan also specifically introduced the implementation of anti-dumping in Mainland China. Of the 47 cases filed against Chinese anti-dumping cases in 2004, the most involved cases were also petrochemical products, a total of 13 cases.
In introducing the implementation of anti-dumping measures by enterprises in mainland China, Liu Huan stated that as of July this year, there were 39 anti-dumping cases filed by mainland enterprises and government investigation agencies, and 24 cases had been finalized and anti-dumping measures had been imposed. Accounted for 61.5% of the total number of cases. The 39 cases involved 120 companies in 23 provinces and cities. It involved 28 cases in the petrochemical industry, accounting for 71.8% of the total number of cases. This also includes seven anti-dumping lawsuits involving petrochemical and chemical fiber products filed by companies in the Taiwan region.
When analyzing the reasons for the frequent occurrence of anti-dumping of petrochemical products, Liu Huan said that the first is determined by the basic properties of petrochemical products. Petrochemical products are basic raw material products, and their physical and chemical properties are easily distinguishable. When they are involved in the case, they are comparable and it is easy to identify similar products. The second is a large variety of petrochemical products, a wide range of downstream applications, long industrial chain, can bring higher added value for the follow-up products, and fierce competition in petrochemical products, interests of ownership and strong opposition, so the high rate of involvement. In addition, some petrochemical products do have disorderly competition and low-price sales, which has led to repeated anti-dumping actions by importing countries and regions.
When talking about how Chinese companies respond to anti-dumping, Liu Huan said that companies must have a sense of law and have the values ​​of competition, participation, and game. They cannot be absent in the legal competition. In particular, he emphasized that the prosecution and the rebuttal are manifestations of their own interests.
